Making a case strategy is necessary while defending against criminal allegations. We must examine the unique facts surrounding the allegations you are facing in order to formulate the best defense possible in your situation. The following are a few variables that could affect the defensive plan:

  • Conditions of your detention
  • Your felony record
  • Your current age
  • The nature of the fees
  • Details of the victim
  • The evidence against you that the state has
  • Minimizing elements

Due to the numerous factors that come into play in criminal trials, our attorneys will need to carefully consider the facts of your case. Our firm’s Atlantic County criminal defense attorney will decide on the best course of action once we have a thorough understanding of all the important details of your case.

Commonly Used Defense Techniques in Criminal Cases in Atlantic County, NJ

In criminal cases in New Jersey, the following are some typical defense tactics:

Constitutional Rights Infringements: On occasion, a zealous police officer may carry out an erroneous search and seizure that results in your arrest. Many of the guidelines that police officers must adhere to when looking into possible crimes are protected by the constitution. A violation of a rule relating to searches or arrests is not only a technicality. Your lawyer might be able to get a lot of the evidence gathered against you omitted from the prosecution’s case under certain circumstances. The prosecution might not be able to establish your guilt of committing a crime without that proof.

Lack of Sufficient Evidence by the Prosecutor: The prosecution must present strong evidence to convict you. When it comes to criminal proceedings, the legal standard of proof is intentionally high. It is a serious action for the state to imprison someone or otherwise take away their freedom. Legal safeguards make it challenging to establish guilt because they require prosecutors to prove their case beyond a reasonable doubt. There are numerous evidentiary restrictions that could bar some evidence from being used. If the prosecutors are unable to secure a conviction, they may choose to dismiss the charges. In other situations, your attorney will fight to have the lawsuit dismissed. The particulars of your situation will determine whether this is feasible.

Positive Defenses: In some cases, your defense won’t be that you didn’t do something wrong, but rather that you had a very excellent reason for doing it. For instance, you can contend that you only acted in self-defense if the prosecution accuses you of battery. Affirmative defenses like self-defense can assist you in disproving criminal accusations. Other affirmative defenses exist as well, such as insanity, duress, necessity, and others. An illustration of duress would be if you disobeyed a traffic signal because someone in your car had a gun to your head and told you to do so. There are numerous additional feasible affirmative defenses. To determine which of these applies to your situation, talk to your lawyer.

About Atlantic County, New Jersey

In 1664, King Charles II of England awarded his brother James, Duke of York, control of the area between the Hudson and Delaware rivers. He was the one who decided to call the new nation Nova Caesarea. Nova Caesarea, or New Jersey as it is now known, has had the same exact borders since the initial deed was written up by the Duke of York. The first permanent settlement in Atlantic County was established in Somers Point. Quaker John Somers was appointed to the positions of Great Egg Harbor’s supervisor of roads and constable by the Cape May County Court in 1693.

The next year, Egg Harbor was formally incorporated into Old Gloucester County. A ferry service connecting Beesley’s Point and Somers Point began at the same time. A sizable proportion of the first settlers were whalers. Shipyards, mills, iron foundries, and brickyards were all located there. Shipbuilding expanded to become a major industry. Large numbers of ships used to stop by our coasts before the American Revolution and the War of 1812. Culture and society in southern New Jersey were only beginning to develop a personality of their own.

Over the course of their histories, each of the earliest communities in New Jersey grew and developed into a unique community. The county seat was moved to Mays Landing in 1837, and the courthouse that was built there in 1838 is still in use today.

Questions and Answers Regarding Criminal Defense in Atlantic County, New Jersey

Get in touch with Michele Finizio from The Law Offices of Michele Finizio right away if you have any queries regarding your case.

In New Jersey, am I able to post bail?

New Jersey’s bail system underwent modification only a few years ago. In New Jersey, posting bail no longer costs money. The new approach is intended to promote fairness, especially in light of the fact that many defendants were unable to post their bonds due to their dealing with financial difficulties. Now, the state can imprison a person only if they endanger the community or pose an unacceptably high chance of escaping.

What effect will my past have on my sentence?

If the state has previously found you guilty of crimes, your first conviction after that could result in harsher punishments. One of many possibly aggravating factors is your criminal history. Other elements that could have a negative impact on your sentencing include the likelihood that you will conduct another crime and the extent of the harm you caused to any victims.

Even though a prior crime could be an aggravating element, there are also mitigating circumstances that could result in a lighter sentence. For instance, the court might consider a lenient punishment if you perform community service, make reparations to victims, show an attitude that says you would probably not commit another crime, behaved without being provoked, and/or are prepared to work with law enforcement.
