New Jersey: Changing Marijuana Laws

In New Jersey, legislators have been pushing forward to legalize the drug, but a number of towns have stepped up to combat legalization efforts with their own laws restricting the substance. Will Marijuana be Legalized in New Jersey?

In November, New Jersey’s politicians passed initiatives to legalize and expand medical marijuana in the state. They approved funding for an expansion of marijuana programs, and they pushed for a complete revision of the rules regarding expunging marijuana-related crimes. Now, they are set to vote on the Marijuana Legalization Act, which would completely legalize the possession of up to an ounce of weed. This historic bill was set to be voted upon in 2018, but disagreements and delays have preventing politicians from voting on it yet. Hotly debated issues regarding the bill include:

  • A lack of understanding on how marijuana will be taxed
  • Conflicts on the appropriate level of taxation
  • Whether there is enough support to pass the bill. To become legal, the bill needs 41 votes in the Assembly and 21 votes in the Senate. Then, Governor Murphy would need to sign it.

Towns Push Back Against Marijuana Sales

Some towns in New Jersey have not taken kindly to the newest push to legalize marijuana. Around 47 towns have taken legal action to prevent the substance’s sale, growth, manufacture or other uses in their areas. Most notably, these jurisdictions include:

  • Berkeley Township
  • Clifton
  • Elmwood Park
  • Fair Haven
  • Hawthorne
  • Oakland
  • West Long Branch
