These checkpoints, sometimes referred to as “mobile checkpoints” or “roadblocks,” are police traffic stops that are not specific to any particular location or suspicion. The Centers for Disease Control and Prevention (CDC) has determined that sobriety checkpoints have the potential to prevent nearly 10 percent of DUI-related deaths.

Some have raised concerns that sobriety checkpoints violate Constitutional rights. Many argue that security checkpoints break the need for a police officer to have probable cause for a traffic stop. While this is the case, New Jersey has decided that sobriety checkpoints are worth it. The U.S. Supreme Court ruled that the dangers of drunk driving are more significant than the degree of intrusion caused by the checkpoints. Therefore, sobriety checkpoints are considered the be an exception to the search and seizure provisions within the Constitution.
