New Jersey Traffic Lawyer Reviews New Distracted Driving Proposal in New Jersey
The term distracted driving usually conjures up images of motorists talking on a cell phone, texting while driving or focusing attention on a GPS device instead of focusing on the road. Now consider a driver who eats while driving, or grooms themselves while behind the wheel. Are they also driving distracted and should they be charged with a traffic violation? Lawmakers in New Jersey think so.
New Jersey Assembly’s Transportation Committee recently approved bill A4461. The bill prohibits motorists from “any activity unrelated to the actual operation of a motor vehicle in a manner that interferes with the safe operation of the vehicle on a public road or highway.”
The bill does not list all of the prohibited activities that constitute distracted driving. This will give police plenty of discretion to determine who is driving distracting, and therefore, who is in violation of the proposed law. The proposal suggests monetary fines for such offenses ranging from $200 – $800. Moreover, a repeat offender risks having their driver’s license suspended by a judge.
The Future of New Jersey Distracted Driving Bill A4461
It is unclear whether or not the bill will be passed into law in the New Jersey as it has yet to be introduced in the state Senate. There is opposition to the vague language in the bill and open-ended list of activities people can do in a car that can be cited as distracted driving.
