Under N.J.S.A. 2C:36-2, possession of drug paraphernalia is a disorderly persons offense.  The legal definition of drug paraphernalia under the NJ statute is anything used to plant, propagate, cultivate, grow, harvest, pack, repack, store, contain, conceal, ingest, inhale or otherwise introduce into the human body a controlled dangerous substance (C.D.S.) or drug.  This offense is typically prosecuted in municipal court.

Possession with the intent to distribute is governed under NJSA 2C:35-5.  This drug-related charge is aimed at perpetrators who are found with drugs on their person, but are not apprehended actually distributing drugs.  Many factors are taken into consideration by the prosecution to determine if a person was distributing or dealing the drugs that they possessed.
