Possession of Illegal Drugs in NJ

Drug possession in New Jersey is governed by NJSA 2C:35-10.  Based on the type of drug offense and the amount of a controlled substance on a person, the type of charges vary in New Jersey.  A person can be charged with offenses ranging from disorderly persons offenses to a first degree offense for possession of illegal drugs.

A charge for possession of illegal drugs is broken down into two categories.  These are actual possession and constructive possession. Actual possession means you knowingly have drugs on your person. Constructive possession is a drug-related offense in which a person can be charged when drugs are not found on their person.  For example, the drugs were found in their car.  In this case, the prosecution must establish a variety of things to prove their case.

Possession of Drug Paraphernalia in New Jersey

Under N.J.S.A. 2C:36-2, possession of drug paraphernalia is a disorderly persons offense.  The legal definition of drug paraphernalia under the NJ statute is anything used to plant, propagate, cultivate, grow, harvest, pack, repack, store, contain, conceal, ingest, inhale or otherwise introduce into the human body a controlled dangerous substance (C.D.S.) or drug.  This offense is typically prosecuted in municipal court.

Possession with Intent to Distribute in NJ

Possession with the intent to distribute is governed under NJSA 2C:35-5.  This drug-related charge is aimed at perpetrators who are found with drugs on their person, but are not apprehended actually distributing drugs.  Many factors are taken into consideration by the prosecution to determine if a person was distributing or dealing the drugs that they possessed.
