New Jersey Criminal Lawyers: NJ Creating Stiffer Penalties for Heroin Dealers
Heroin falls into the category of a highly potent substance and its use in the state of New Jersey is on the rise. Lawmakers are doing what they can to put an end to this problem, but unfortunately the challenge of reducing the number of heroin users is monumental. Recently, the New Jersey Division of the Drug Enforcement Administration (DEA) announced that heroin in New Jersey is extremely pure. This makes it easier for users to snort the drug without having to deal with the problems associated with needles. As a result, heroin is more enticing as a drug of choice and has brought the growing epidemic of heroin offenders into various suburbs, towns, and cities within the state.
To combat the increase in heroin use, New Jersey has been focusing on using monies to fund drug prevention programs and provide drug addiction services. State legislators support these programs, and in addition want to bring drug dealers to justice. This includes enforcing stronger penalties for the distribution of heroin that are more fitting of the crime.
As proposed under the 9th District Legislators initiative (A-783/A-2831) penalties for heroin offenses would become more stringent for the following:
- Offensives involving manufacturing, distributing, or dispensing heroin.
- Offensives involving possession with the intent to manufacture, distribute or dispense heroin.
- The threshold for first degree offenses would be lowered from five ounces to 2.5 ounces or more of heroin.
- The threshold for second degree offenses would be lowered to 0.17 or more ounces but less than 2.5 ounces of heroin.
- A third degree offense would involve less than 0.17 ounces of heroin.
Members of the state assembly feel the changes are imperative in order to win the war on heroin. State senators are also working on bills to create stiffer penalties for heroin dealers and users. It is now up to the Senate Judiciary Committee to take action so the bills can become laws.
