On Monday, February 22nd, New Jersey Governor Phil Murphy signed three bills into law that will not only decriminalize a certain amount of marijuana but implement the sale and taxation on its recreational use moving forward.

Can I Still Be Arrested for Possessing Marijuana in NJ?
Yes – but only under certain circumstances. Under this new law, New Jersey residents are legally allowed to purchase and possess up to six ounces of marijuana. You will be free to smoke in the privacy of your own home. However, it will still be against the law to purchase or possess any amount of six ounces. In addition, you will not be allowed to smoke on public transportation or on public streets.
When Can I Purchase Weed in New Jersey?
While under this new law you will eventually be allowed to purchase marijuana, the time hasn’t arrived yet. According to Governor Murphy, it could take six months for residents to make their first purchase, however, industry experts disagree. In New Jersey, there are more than 8 million people who rely on marijuana for medicinal purposes. While this new law will expand to cover those who want to smoke recreationally, industry experts want to make sure that there will be enough available for existing patients first before moving forward with this expansion. As it stands, you could be waiting closer to a year to make your first legal marijuana purchase in New Jersey.
What Happens to My Criminal Record Now That Weed is Legal?
While progress is being made to vacate existing criminal records, this hasn’t happened…yet. However, if you have criminal charges currently against you, they will be thrown out.
