New Jersey Criminal Lawyer Explains How DUI Charges Can Affect Personal Records
New Jersey is one of only two states in which a DUI or driving under the influence of drugs or alcohol charge constitutes a motor vehicle violation and not a criminal offense. A DUI conviction in the state of New Jersey will remain permanently on Department of Motor Vehicle (DMV) records; however, criminal records will not be affected. Therefore, it is not necessary for an individual charged with DUI in New Jersey to expunge his or her records after being convicted because expungement of records in New Jersey only applies to criminal records.
DUI offenders often fear that their convictions will affect future employment; however, in many cases the effects can be minimal or nonexistent. For those convicted of DUI in New Jersey, it is not necessary to disclose a DUI charge on a job application that questions whether the applicant has ever been found guilty of a criminal offense. Furthermore, because New Jersey does not report motor vehicle violations to the National Crime Information Center (NCIC), it is possible that a DUI conviction would not be exposed during a routine background check or record search. While some jobs will require an applicant to disclose a DUI, the Civil Rights Act of 1964 prevents potential employers from denying a job to individuals with conviction records unless they have a compelling business reason.
Although a DUI charge is not a criminal offense, it can incur criminal penalties. Sentences will be imposed somewhat subjectively by a municipal court judge who will determine the severity of the offense and the resulting penalties. The law in New Jersey requires a minimum sentence of 180 days in jail for third time offenders.
