Every client’s case is different, and we are aware of this at The Law Offices of Michele Finizio. To better understand our clients’ concerns and case objectives, we take the time to get to know them. We also look into the criminal accusations made against our client in great detail. This aids us in creating the most effective plan of action for each client’s situation. In other situations, we can use the evidence to create a successful trial plan. In opposition to the state’s evidence, there are numerous possible defenses, including:

  • Arguments against the evidence’s relevance
  • Arguments against the admission of evidence, such as when forensic evidence is not supported by science or when law enforcement gets the evidence in violation of your constitutional rights
  • Questions regarding the state’s witnesses’ trustworthiness
  • When the state fails to provide evidence for each element of each charged offense, there may be challenges to the sufficiency of the evidence.
  • Procedural allegations, such as neglecting to give you a speedy trial

Every situation has its own distinct facts and circumstances. Regardless of how straightforward or complicated your case may seem, we look into every alternative at The Law Offices of Michele Finizio so that you have the option for the best outcome in your case.

About Mercer County, New Jersey

Mercer County was made up of parts of neighboring counties on February 22, 1838. It has a long history that goes back to important American Revolutionary War battles. General George Washington led the American troops as they crossed the Delaware River to get ready for the Battle of Trenton, also called the First Battle of Trenton, which took place on December 26 in the morning. After the battle, Washington went back to Pennsylvania. He crossed again when General Charles Cornwallis’s army was attacked by surprise at the Battle of Assunpink Creek, at the Battle of Princeton. The successful raids made the colonists who wanted to be free feel better about themselves. Ewing Church Cemetery is one of the oldest cemeteries in the area. It has been serving the Ewing neighborhood for 300 years.

There are the graves of a lot of soldiers from the Revolutionary War to the Vietnam War. During the first half of the 20th century, the county saw a huge increase in urbanization and population due to the growth of the industry in places like the city of Trenton. Mercer County was where a mythical Martian invasion of the United States was said to have started. In 1938, Orson Welles did a radio play called “The War of the Worlds.” It is one of the best-known American radio plays in history. The first time his made-up aliens “landed” was in West Windsor Township. At Grover’s Mill Park, a memorial has been built to honor someone.

Frequently Asked Questions Answered

Do I have to talk to the police after being detained?

No. When you are taken into custody, the police must recite your Miranda rights, which include the right to an attorney and the right to remain silent. Consequently, you are under no obligation to respond to any inquiries from the police (except that you must properly identify yourself when asked). Never offer the police answers or information that you know or believe to be false, as doing so could be considered a criminal act in and of itself. Instead, you should get advice from a skilled criminal defense lawyer before deciding whether to cooperate with the authorities or respond to their queries.

What distinguishes a disorderly person’s crime from an indictable offense?

In New Jersey, a disorderly person violation is similar to a less serious misdemeanor offense, whereas an indictable offense is the same as a felony offense.  Indictable offenses are heard in the superior court and punished with jail or prison sentences of six months or more. While disorderly person violations are typically heard in municipal court and carry imprisonment terms of less than six months and commonly none at all.
