If the victim of an internet crime is a government agency—any government agency—a mandatory minimum period of parole ineligibility applies. The period can last between one-third and one-half of your full sentence. Further, it is not a defense if you did not know that the victim was a government agency or if you did not mean to impact a government agency.

Are there any aggravating factors that can make internet crimes more serious?

Yes. Charges can also be elevated to first-degree charges if someone was seriously hurt or if damages or a loss of more than $250,000 was involved. These first-degree charges can result in up to 20 years in prison and also carry a minimum “time served” requirement so that you must serve between one-third and one-half of your sentence without the possibility of parole.

What is sexting?

The New Jersey legislature has realized that this result would be inappropriate if all parties involved were minors.
