The internet is literally everywhere we go nowadays. Almost all of us carry a smartphone that provides continuous internet access regardless of our location. The Law Offices of Michele Finizio has a proven track record of success that you can rely upon. The firm is dedicated to remaining current in the face of rapidly changing laws and technology. The firm handles cases throughout New Jersey, so if you have been arrested on allegations that you committed a cybercrime, call or contact us as soon as possible to speak with a qualified New Jersey internet crime attorney.

It is equally unsurprising that New Jersey courts treat internet crimes more seriously than ever given the important role the online community plays in all of our lives. The Law Offices of Michele Finizio can provide the strong, strategic defense you need to fight allegations that you committed an internet crime. The firm combines over 15 years of legal experience with a passion for creating innovative solutions for clients charged with cyber crimes.

Most internet crimes are graded as second or third-degree indictable offenses. If convicted, you could face up to ten years in prison and a felony on your record. Some convictions even carry a presumption of incarceration that would mandate prison without parole. In short, even though internet crimes are most often “white collar” crimes, you cannot afford to take risks with your defense.

Types of New Jersey Internet Crimes

New Jersey Internet Crime Attorney

Just as so many facets of life have moved online, the range of internet crimes that exist is extremely diverse. The Law Offices of Michele Finizio defends clients who have been accused of all types of internet crimes, including:

  • Hacking
  • Phishing
  • Financial fraud, including credit card fraud and theft perpetrated online
  • Identity theft
  • Illegal internet gambling
  • Child pornography
  • Cyberstalking
  • Solicitation of a minor online

Computer and internet crimes are defined very broadly in New Jersey. Examples of the types of charges you may face include the following:

  • Knowingly or purposely, and without authorization, accessing any computer, computer system, online data, database, computer storage medium, computer program or computer network, are third-degree charges. Note that this is a crime based on mere illegal access—altering, damaging or destroying information found through the access can lead to second-degree charges.
  • Online theft is generally a third-degree crime unless the defendant attempted to obtain something of value in excess of $5,000, in which case second-degree charges will apply.
  • When any type of internet crime results in substantial impairment or interruption of public transportation, communications, water supply, gas/power or any other type of public service, the crime can be graded as a first-degree offense.

Penalties for internet sex crimes involving minors are, of course, even more extreme. Defendants convicted on these types of crimes can be subject to New Jersey sex offender registration requirements—even if there was no physical contact between the defendant and anyone else.

Regardless of the type of internet crime involved, you need the best possible defense team in your corner. The Law Offices of Michele Finizio is here to put more than two decades of experience to work in your case. Call or contact the firm as soon as possible to schedule your free and confidential initial consultation.

Providing Strong and Innovative Defense Solutions for Clients Arrested on Charges Involving Internet Crimes

Evidentiary issues in cases alleging internet crimes are often complex. The Law Offices of Michele Finizio works with the foremost computer and technology experts available to build a strong defense tailored to your case. Many internet crimes cases involve allegations that you illegally accessed:

  • Email accounts
  • Computer networks
  • Bank accounts or financial documents
  • Credit card statements
  • Employee databases

In other cases, defendants may be accused of spreading spyware in order to gain access to sensitive information—or even purposefully using certain types of programs to monitor an ex’s computer activity. Even the most seemingly “innocent” of computer crimes must be taken seriously.

Laws criminalizing online activity are not going away anytime soon. If you have been accused of committing an internet crime, don’t let the prosecutor take advantage of these strengthening laws. New Jersey Internet Crime Attorney Answers Frequently Asked Questions

When can conviction for an internet crime result in a mandatory minimum period of parole ineligibility?

If the victim of an internet crime is a government agency—any government agency—a mandatory minimum period of parole ineligibility applies. The period can last between one-third and one-half of your full sentence. Further, it is not a defense if you did not know that the victim was a government agency or if you did not mean to impact a government agency.

Are there any aggravating factors that can make internet crimes more serious?

Yes. Charges can also be elevated to first-degree charges if someone was seriously hurt or if damages or a loss of more than $250,000 was involved. These first-degree charges can result in up to 20 years in prison and also carry a minimum “time served” requirement so that you must serve between one-third and one-half of your sentence without the possibility of parole.

What is sexting?

Sexting is a term used when two or more minors distribute illicit or sexually suggestive images or texts over the internet. If an adult was involved in these types of behavior, extremely harsh child pornography laws would apply. The New Jersey legislature has realized that this result would be inappropriate if all parties involved were minors. Sexting is also serious, however, it is usually punished at the juvenile level unless aggravating circumstances warrant more serious charges.
